@BlueStateBabe without their phone records you can't prove much, but you could easily catch them in those lies if they were questioned on record. Where they were going, why they were there, what they saw and why they were texting each other at the time of the accident etc

@BlueStateBabe my take is, if they weren't there to witness it, they're not a witness. So the GPS is a piece of physical evidence vs a non-witness testimony, which is why I think you'd have a good chance with a small claims case.

I assume an officer responded to assess the events, if there wasn't a witness there, they wouldn't be in the police report that you would be able to request a copy of that shows that no witness was present. That's what I had to do.
