Even the brokers are getting nervous about it. This could all reflect badly on them and they don't want to be associated with it.
Even the seller's agent is getting nervous. She was all, well "That's home ownership" until her reputation was being threatened.

Spoke with the tech today, another company about the AC.
He stated that the AC does NOT need to be touched to replace the furnace. I had a feeling.
Its just keeps getting better and better.
Spoke with a Real Estate Attorney today.
Nothing we can do about the un-permitted improvements. CO does not require them to be permitted as long as they were disclosed, which they were.
We can go after the sellers for the furnace. Attorney said repair, but they DO NOT repair heat exchangers, they replace units. So it is the cost of s new unit.
Our realtor reached out to seller's employer, they are conducting an internal investigation.
So any work on the AC unit may require us to replace the unit. 🤷♀️
The company also wants to remove all the freon in our AC unit to replace our furnace.
???
Will inquire about that on Monday with another company coming out for another estimate.
But I am not an HVAC Tech, so I don't know.
Still waiting to hear from the insurance adjuster.
Realtor recommended an arbitrator for further action.

So the sellers have not responded to inquiries from their agent regarding the furnace.

Had a company come out yesterday, neighbor came over and recommended us NOT use them. Everyone in the neighborhood has had issues with their work, including warranty work.
They also want us to replace our AC. The freon in our system has been outlawed. (I have not verified this information)

Blue Ribbon is the warranty company. I have no ill will toward them. If it weren't for them, we would not have discovered the dangerous state of our furnace.
They are willing to pay the amount they would have paid for a new circuit board ($400) toward a new heater as a good faith payment, to whomever we choose to replace our furnace.
That was addressed toward the inspection company and the at supposed "technician" that serviced the furnace.
Believe me, Blue Ribbon is just as flummoxed over this as we are. Hence the tone of the statement.
We have kicked the hornets nest as it were with this situation.
I'm still confused as how the President sets the prices in a free market economy.

Warranty company just sent a scathing letter on why they denied replacement.:
"If the inspector’s recommendation had been followed, the issues with the heat exchanger would have been discovered at that time, which is why inspectors generally recommend gas burning appliances be checked by a licensed professional prior to close of escrow. The evidence of the damage to the heat exchanger is documented on the invoice Reliable left behind."

One would think. But like any after market warranty they have sooooooo many loopholes.

If you saw the pictures of the cracked heat exchanger it’s pretty evident that it’s been a while. There is rust on some of the cracks.
Apparently, the company that “serviced” our HVAC system is a gas company that the seller works for and the seller was the technician that serviced it. Now, normally that would be fine, but Blackstone doesn’t do HVAC.
So we have a bad faith thing going on and my agent is LIVID.

Yup. The warranty company said the heat exchanger was bad before we bought the house.
They can pay for a new circuit board, which is bad. $400, but won't pay for a new furnace. 😡 🤬

We moved to CO in Sept.
You must be a resident for 90 days to get an ID, change your DL, etc.
You can register to vote up to election day, from what I read. I'll have to double check. It is a bluer state.
I do still have a valid CA address.
