@Smersh Trump judge. Nazi jurist.
@TwiHusband bad take.
Colorado judges are appointed by the governor, in this case the DEMOCRAT Jared Polis appointed her earlier this year.
@Smersh Biden appointed Merrick Garland. A serious mistake in my estimation. Democrats are not incapable of error, nor are they immune to having the wool pulled over their eyes.
I would probably be one of the last on CoSo to argue that Democrats are perfect. 😉
IMO it's playing the same game that the right does when we immediately view court rulings through a partisan lens. Yes, many rulings are political (most?), but we also need to be able to know when someone has found a loophole and the constitution needs mending.
Although, good luck getting 2/3s of States to agree on a fix in our hyperpartisan environment...
@Smersh Ah, a Constitutional Convention. The Kochs' wet dream. At our current state, I half expect them to introduce an amendment, any day now, repealing the 19th.
As for loopholes, that why a "good" judge sits on the bench. To exercise common sense, and not allow a square peg to be hammered through a round hole.
@Smersh Not for nothing, but every time we try to keep it "non-partisan", while the Right goes hyper-partisan (note: there is no actual 'moderate right' anymore) we end up getting our brains beaten out with a gerrymandered shovel. It's gotten really old the last 50 years or so.
Sounds like a Dem candidate quality problem. 🤷♂️
This whole case is a moot point anyways because Colorado isn't giving our delegates to Trump --whether or not he's on the ticket.
There is however, a very real chance that we and other, non-coastal states will give our delegates to a "not Biden" candidate should the Reps choose to run someone not on trial.
@Smersh I rest my case.
@Smersh I mean if Trump makes them gag, but your average run of the swastika Republican doesn't even give them pause, there's no point in even trying to sway them.
@Smersh I wish our legal system allowed judges to fix bugs in the code when they find them.
@peterquirk as long as they can't push to production without a review.
@Smersh It's not clear that the previous code was reviewed. They should involve judges in the review.
@Smersh Coward
Judge Sarah B. Wallace’s 102-page ruling "found that while Trump “incited an insurrection … and therefore ‘engaged’ in an insurrection,” the 14th Amendment “does not apply to Trump” because he is not an “officer.”"
"“Part of the court’s decision is its reluctance to embrace an interpretation which would disqualify a presidential candidate without a clear, unmistakable indication that such is the intent of Section Three,” she wrote."
