“Separation Between Chirch & State” isn’t in the Constitution.
“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof".
So where do people get the “separation of church and state”? From Jefferson’s writings. The actual concept was NOT that religion would infiltrate government but that government would corrupt religion (yeah, funny, eh?)
Given how today’s SCOTUS seems to find REAL history repugnant…
You're right... I got sucked into the Establishment Clause of the First Amendment with the Lemon v. Kurtzman (1971), the Court established a three-pronged test for laws dealing with religious establishment. College freshmen ready to set the world on fire with the total separation of church & state.
Imagine my surprise when my professor told me it wasn't set in stone.
Now a few (hundred) years later... I want this written in our laws. Can't trust #SCOTUS anymore
