Gov Abbott: "The 5th Cir. Court of Appeals' denial of Texas' sovereign authority to secure the border with floating marine barriers is clearly wrong," he wrote. "AG Paxton & I will seek an immediate rehearing by the entire court. We'll go to SCOTUS if needed to protect Texas from Biden's open borders."
Texas isn’t sovereign. Nor does it control the borders. When you join the United States you cede the borders to the Federal Government. Even the Fifth Circuit (the buffoons that they are) gets it
I’m NOT a lawyer and even I can see the logical flaws in Abbott’s “reasoning.”
It is fluff and nonsense.
He is trying to argue that Texas has a responsibility where it does not. That it has a legal obligation where it does not.
He is a horrible lawyer and a terrible governor.
We need a Democratic governor not a dictator wannabe.
Exactly (this is what I was attempting to get at in my own clumsy way).
Our Governor is off his rocker. He is under the delusion that Texas is its own country and he is king.
To me this represents a problem with the Republican Party in Texas. They are so desperate to stay in power they will violate any and every law to do so.
In Texas the MAJORITY is non-white. This is the true fear of Abbott and the Texas Republicans.
@feloneouscat actually, I think you said it well because your point is from the point of view of Texas. I agree about the GOP but think it’s true everywhere in the country now.
@feloneouscat you are absolutely right (and I am a lawyer), but there’s another more fundamental point. No state is entitled to conduct foreign policy on behalf of the United States and that’s exactly what you are doing when you are telling another country when, where, and how they can enter the United States. And let’s be clear, they are entering the US, not Texas and they are breaking federal laws, not state laws by doing it.
