Texas isn’t sovereign. Nor does it control the borders. When you join the United States you cede the borders to the Federal Government. Even the Fifth Circuit (the buffoons that they are) gets it
Biden doesn’t control the borders. That is Congress’ purview. And right now the House is more interested in Hunter Biden than they are the border.
Basically, everything Abbott says is wrong. The brain dead Fifth Circuit, for once, gets an easy peasy Constitutional question right.
Texas is NOT sovereign. It isn’t a country. It does NOT control the borders. No matter how much Abbott screams about it, the Feds are responsible.

It is fluff and nonsense.
He is trying to argue that Texas has a responsibility where it does not. That it has a legal obligation where it does not.
He is a horrible lawyer and a terrible governor.
We need a Democratic governor not a dictator wannabe.
@feloneouscat you are absolutely right (and I am a lawyer), but there’s another more fundamental point. No state is entitled to conduct foreign policy on behalf of the United States and that’s exactly what you are doing when you are telling another country when, where, and how they can enter the United States. And let’s be clear, they are entering the US, not Texas and they are breaking federal laws, not state laws by doing it.
