If anyone is interested in a deep dive into Detroit/Wayne County's 2020 election audit, here's the Michigan Secretary of State's report. Detroit begins on Page 19; fairly technical, but it explains the "out of balance" phenomenon that twists out of proportion.

Basically, it's a sorting issue as ballots are collected. Sometimes they go in the wrong bin. The sorting issues are corrected by county clerks in the days following the election.

This was a state court judge ruling. It was never appealed because we ran out of time (and money).

Nonetheless, I can see deciding that Colorado can't exclude Trump from a *primary* ballot due to freedom of association, because the CO GOP has that right.

But for a *general* election ballot, the circumstances might be different.

Tossing this out as an anecdote ...

Duke v. Smith was a 1992 state court case in which several fringe presidential candidates sued to gain primary ballot access. (I worked for Agran's campaign.)

The judge ruled that a political party is like a private organization, with freedom of association, therefore it can choose whomever it wants on a primary ballot. (1/x)

From Denver Post on ballot ruling:

"The Supreme Court, in a 4-3 opinion, found that Trump is barred under a provision of the 14th Amendment that prohibits people who engaged in insurrection from running for office, based on his actions surrounding the Jan. 6, 2021, U.S. Capitol breach and riot by his supporters."

Note -- All seven court members were appointed by Democratic governors, including the three who voted with the minority opinion.

Regardless of the candidate, I'll be curious to see if picks up the ruling.

Typically questions about access to a state ballot rest with the state court. This isn't a general election, it's a state primary to determine who represents the Colorado Republican Party.

SCOTUS intervened in Florida's 2000 count, but that was a general election.

Given this court's majority tendency to side with states' rights (e.g. Dobbs), maybe SCOTUS will decline to pick it up.

Here's why this won't work ... Other than the obvious (federal jurisdiction), if local police enforce this their jails quickly will fill up. INS won't come to get them, because it's a state law.

When I was in law enforcement in the 1980s, we didn't detain suspected immigrants for this reason. No place to put them, better things to do with the jail space.
