as far as i know, based on your description, this can legitimately be objected to and appealed to the State Board of Education.
i would first make a personal phone call to the local School Superintendant objecting to this software being used in manner not meeting State requirements and formally requesting investigation. [Document EVERYTHING]
If no action/satisfaction from Super, write editorial in newspaper & contact State Bd of Ed
