Note to prosecutors: if you’re going to hide exculpatory evidence, try to avoid doing so in a nationally covered case. It looks bad on your resume.
Why the defense in Alex Baldwin’s involuntary manslaughter case in New Mexico were able to get a dismissal with prejudice:
It’s the basic rule of criminal prosecution that you don’t hide evidence. It’s not only unethical, if discovered, the judge can dismiss the case without the possibility of a re-trial, just like they did here.
It’s the ultimate no-no for prosecutors.
Yup. Mistrials often result and things become Higgledy-Piggledy ("a real mess" - Mike Binkley, Bloom County).
@evamarie Question: Baldwin was a producer on the film and to me that's where his culpability lies. I don't understand why the judge didn't allow this. When she dismissed the case WITH prejudice, does this mean he cannot be tried again as a defendant even though he was a producer on the film?
Pretty much, yes.
@XaoslordErie Thanks!!!
Happy Sunday!
@XaoslordErie Back at ya🌞
I believe the theory of charging Alec Baldwin was that he was actually practicing shooting using a gun with live ammo and should have known better.
The evidence the prosecutor hid was that lots of live ammo was brought in by a 3rd party without anyone’s knowledge.
The defense found out about this in the middle of trial so they could not use the evidence to mount the defense they should have.
“With prejudice” means it’s dismissed forever.
@evamarie Excellent summation. Thank you!
@evamarie This happened in DUI case in nowheresville Tennessee. Police fuck up.
@evamarie
Yeah, they really did drop the ball on that one. I've been following the case when it reared its' head, and sometimes the arrogance of certain parties really made / makes them look imbecilic.
