I've seen some commentary about trump, specifically (theoretically) that he can gain the R nomination, win the general, and take the presidency WHILE INCARCERATED. Does anybody know if that's true?...again, theoretically. I'd love to hear Jamie Raskin or Adam Schiff react to the question.
@mcfate I understand it's unlikely, probably impossible, but just wondering if there's any way. One could argue that he didn't execute his presidential duties when he WAS in the White House. He might actually agree with that, and thus say that is an irrelevant criterion, particularly since he's the one who decides what those duties are. He obviously doesn't care about constitutional norms.
Presidents need to be able to travel to places. They have to meet with people.
He's not going to be a credible participant in an international crisis doing it from a penitentiary.
An opinion about his performance when he was in office is kind of a silly point to lean on here.
Is there some value in this for you? You feel being incarcerated is a quality independent voters are seeking in a Presidential candidate?
This seems something like asking whether a reanimated corpse can be President.
There's no rule against it.
@mcfate Oh, no. Not sure what you mean about value. That's ludicrous. I'm just imagining the kinds of bile he'll spew if he sees any opening whatsoever. He's a worthless POS, of less than no value.
I'm muting this thread.
@mcfate ok.
@celticsfanaticentomologist yes per University of California, Los Angeles law professor Richard L. Hasen. There is no Constitutional restriction. Eugene V. Debs ran for President in 1920 while incarcerated.
@CanisPundit @celticsfanaticentomologist Be funny if, like Mr. Debs, (rest his soul), Trump only gets 5% of the vote. ; )
@AskTheDevil @CanisPundit Actually, my point is that trump treated a lot of things while he was the officeholder as legal for him to do or not do if they weren't specifically allowed or disallowed. Those things that are norms or traditions or generally accepted moral expectations, not backed up by laws, can be ignored. That seems to be at least part of the trump MO.
@celticsfanaticentomologist @CanisPundit Oh, certainly.
@AskTheDevil @CanisPundit Example...pulling out of NATO. (my head exploding at the thought)
@celticsfanaticentomologist @CanisPundit I'd hate for Trump to know that I might have popped a blood vessel in my eye and spit-took a mouthful of hot coffee when I first heard him float that.
@celticsfanaticentomologist exactly. @AskTheDevil
@CanisPundit OK. That sounds authoritative. Kind of what I was starting to think.
@celticsfanaticentomologist once I get my time machine operational I'll visit the Constitutional convention and share a few ideas.
@celticsfanaticentomologist
I can't see how he could "execute the duties of the Office of the President" while locked in a jail cell. The Congress would impeach him, or his Cabinet would 25th Amendment him.
He's not winning any general elections.
