As much as I like Kelly, he isn't the perfect candidate even if I still think he's the best one. But be prepared to hear the bad stuff because it does exist.

It seems the cited dispute had a background. The nominee had served in the same post under Obama and was known for using an interpretation of independent contractor that had been found to be outside the rules of the department and which had the effect of shifting a lot of responsibility onto potentially vulnerable small businesses. So in fairness I'll link that discussion as well.
