Understand all that, what I'm not clear on is exactly what Max's servers are seeing that's running afoul - the tunnel itself or the v6 connection.
because my v6 addresses are associated with an HE tunnel, they're treating it like I'm using a VPN to bypass their georestrictions

It makes me wonder if I try to access Max through my wireguard tunnel, if I would run into a similar issue? Maybe not, because my tunnel just goes back to my home network so I can have all my filters away from home.
yeah, if max is seeing your local ISP IP addresses, you'll be fine...
they just randomly decided that my HE v6 allocation is "zomg tunnel!!!" 🙄

tunnelbroker is for v6...back then, no ISP offered native v6...some still don't...and mostly the way they do kinda sucks
so I have a v4 native connection to my local ISP, and build a v6 tunnel to HE (over v4...it's a 6in4 tunnel)
everything on the network is dual stack, and prefers v6...which resulted in max saying their service isn't available in my "area"...
