Judge nixes firearms legislation on “Based on the text, history, and tradition of the Second Amendment, this law is clearly unconstitutional.” — surprisingly the phrase “text, history, and tradition” is not found in the Constitution and could be used to continue everything from genocide of native Americans to misogyny.
This Supreme Court is creating non-laws as barriers to prevent States from protecting its citizens. Lower courts are using these non-laws.
@feloneouscat
An amendment alters something.
The second amendment alters Article 1 Section 8, clauses 15 & 16 that define militia creation, operation, and funding.
It has nothing to do with an individual right to bear arms.
Gun nuts always want you to ignore the introductory phrase about "well regulated militia", but it's there to make clear what part of the Constitution is being amended.
Color me "originalist"
@BrentSullivan @feloneouscat
I tell gun nuts if they want to be part of a well-regulated militia, and do it honorably, the recruiter has plenty of enlistment forms.
@Priestess @feloneouscat
You're an originalist too 😁
@feloneouscat The word 'gun' is NOT in the U.S. Constitution but a 'well regulated militia' IS.
