“The Republicans are asking the Supreme Court, which has a 6-3 conservative majority, to embrace a once-marginal legal theory that has gained favor among some conservatives called the "independent state legislature" doctrine.”
SCOTUS literally wants to change election law without changing the Constitution. What they are doing is wrong.
It’s equivalent to Hunter Biden’s laptop.
They are going to do it anyway.
@LindaGoodliffe There is debate on that. As much as people think the Constitution is well written, it has a lot of holes in it. That’s where this Conservative Theory took root.
The IDEA is that Legislatures are mostly Republican and thus can change elections regardless of the actual election.
It’s a really awful theory but so is discrimination and we will see the court rule in favor of it as well.
@feloneouscat It’s hard to avoid despair with our laws crumbling in front of our eyes. I don’t know how we come back from this. Thank you for the explanation. 🥰
@LindaGoodliffe There is hope! It appears that Amy Conehead Barrett may rule against it! It will be close.
Still, not saying Democracy won until the court rules.
@feloneouscat I REALLY hope you’re right!! 🥰
@LindaGoodliffe I hope Barrett doesn’t get convinced to change her mind.
As I say, I’m not resting easy until it’s all said and done.
@LindaGoodliffe Short form is yes and no. Under the Constitution states decide how elections are held. The theory is that because state legislatures do that, they can also decide EVERYTHING even changing who won.
Not exactly what the Framers had planned.
Might as well go back to the Articles of Confederation. SCOTUS is atrocious, and their reputation is somewhere south of the sewer.
@feloneouscat Wouldn’t that go against articles in the Constitution?
