THE DOJ ASKED THE SCOTUS TO INTERVENE IN THE MIFEPRISTONE RULING. THEY ARE APPARENTLY GOING TO HEAR THE CASE, SINCE THEY HAVE TEMPORARILY HALTED THE LIMITATIONS ON THE DRUG.
NOW, TECHNICALLY, THIS ISN'T A RULING THAT SHOULD BE BASED ON IDEOLOGY. IT SHOULD BE ROOTED IN FACTS AND SCIENCE.
@factivist_0207 Technically, even beyond that, it can be rooted in a basic rule of federal procedure: the plaintiffs do not have standing, because they have not been harmed in a way that is concrete, particular, and actual or imminent, where the act they attempt to enjoin caused that harm, and a court can actually do something about it.
"We might get some patients who have complications" is none of these.
It'd be a punt for SCOTUS to overturn the ruling for standing, but I'll take a damn win.
