Saying that is their way to try to get out of paying unemployment for the majority that they're laying off.
It won't hold up, but a lot of people will be harmed in the process.
@estherschindler Ouch. So now all the laid-off employees are tarred with the PIP brush, because no one knows who's who. This happened at a company I worked for once. The CEO of said company ended up fleeing to Mongolia for reasons which were unrelated but in character.
