SCOTUS works in the world of technicalities. If they leave that world they become "activists".
Today's decision was within that technical world.
Distasteful, but within their disciplined context. That's why 3 liberal judges sided to make it unanimous.
The issue I have is “Because the Constitution makes Congress, rather than the States, responsible for enforcing Section 3 against federal officeholders and candidates, we reverse.”
Congress??
And how will that impact the trials?
@jurban I would love to see the part of the 14th amendment, or the constitution, that says only Congress is allowed to act.
This was judicial activism disguised as a technical vote.
