based on nothing at all, I'm going to predict that SCOTUS will be unable/unwilling to weasel out of the "what matters is how the founders would have understood the constitution" trap that it set for itself. They will affirm CO`'s ability to find trump ineligible for the office of president. Several other states will then follow CO's lead.

@rpardee And it has nothing to do with "the Founders". It's an amendment, and the plain meaning of the text is clear.

@rpardee The stumbling block I see is that they won't want to call Jan. 6 an "insurrection". But neither can they come out and say that it wasn't one. It was on live TV.

@LiberalLibrarian well, as an appellate court, they *should* accept the findings of fact of the trial court, unless there is "clear error", which is supposed to be a really high bar.

Mind you I would not trust Alito & them to adhere to this at all--they don't seem super committed to this rule. So really I'm fantasizing here...
