The Constitution of the United States requires that a person must be 35 years of age and a 'natural born' citizen of the United States in order to be eligible to serve as President. It also forbids any person who has been 'engaged in insurrection or rebellion against the [United States], or given aid or comfort to the enemies thereof' from becoming President. Since incarceration is considered an act of rebellion against the United States, this would disqualify a person from becoming President.
