If Trump loses and incites his followers to violence, should he be immediately apprehended and held without bond until trial?
@mcfate @EvilBunny pretty sure he'll be charged with treason, terrorism or some such... since that's what he's doing
Um, "treason" requires doing something for the benefit of a adversarial foreign power to the detriment of one's own country. Which foreign power would he be lending aid and comfort to, and how would you prove that?
"Terrorism" requires performing some action with greater real world impact than talking.
At best, you might make a case for "inciting a riot", but that's a difficult charge to prove when all the incitement is words. The First Amendment still exists.
I submit that you'd never get a grand jury to return indictments on either of those charges.
The "elements of the crime" don't exist.
@EvilBunny Holy shit, yes.
@EvilBunny if the justice system worked for trump the way it works for everyone else, he’ll be in prison on Election Day. But we all know that’s not gonna happen.
Um, we charge people with crimes before we apprehend them. That takes a grand jury.
We generally only "immediately apprehend" people if they're caught in the COMMISSION of a crime, not because they make us mad.
How come you seem to dislike due process so much, at least when it comes to people who offend you?
Agree.
If they think “Sleepy Joe” isn’t locked & loaded they will find out the hard way.
No 2.0 on his watch.
@EvilBunny Ummm....HELL YES!!!
If he incites violence, then haul him away.
@EvilBunny So far, he's been convicted of rape, campaign violations, and he also incited a violent insurrection.
If we haven't thrown him in jail without bond for any of those, I wouldn't hold my breath.
@EvilBunny yes
