Grand Jury doesn't have to meet for indictments to be issued.
@Bliss I think you are mistaken. Without a grand jury indictment, the prosecutor has to demonstrate to the trial judge that they have enough evidence to continue with the case. so it would take LONGER without the Grand jury. However, with a grand jury indictment, the prosecutor can skip that step and proceed directly to trial.
please, if you have knowledge on how the Manhattan DA and the grand jury handle cases that would agree with your thursday/Friday statement I would like to know how
I believe you misunderstood me.
Once the grand jury decides votes to indict they don't have to be in session or meeting for the DA to inform the clown's lawyers of the charges and schedule an appearance for the arraignment.to take place. That's how they do it in Manhattan with all high profile cases. In fact, They prefer that the Grand Jury not be in session and that most of the court are empty when indictments are handed down. The court administrative days are usually Fridays.
BTW, when I say the grand jury is not is session I am referring to the fact that they are off or not meeting on that particular day.. Most Fridays are administrative days, which means only attorneys, judges and court staff work and meet. Motions are brought forth, argued and or decided on that day. Hope that helps to clarify what I meant that I expect an indictment by the end of this week.
Yes i know they are still taking witnesses. A grand jury having a day off does not mean indictments dont happen. When the grand jury decides on the charges that piece of paper goes to the DA's team that handles indictments. The team dealing with the grand jury is a different team. That's why the grand jury doesn't have to be actively in session when indictments are announced or executed.
