Interestingly, the Dred Scot decision was about states right -- the right to NOT have federal marshalls come into free states like Pennsylvania and kidnap people they thought were fugitive slaves. (Not like they would return anyone who they kidnapped in error.) The Supreme Court said the states didn't have that right, and the South was cool with that.
