How does a gallows get built without premeditation?

The 'gallows' built on Jan 6th was symbolic. It could not have been used to actually hang an adult - too flimsy and not tall enough. This is likely why presence of gallows structure does not indicate premeditation.Means must be usable to commit crime for that finding.

This was a hastily built, rickety structure that had the noose hanging over the platform.

Absolutely sure the people with skills necessary to assemble this 'gallows' knew it was not sturdy enough to hold the weight of an adult male. Common sense dictates that in order to hang someone, the noose must be off the ground more than the height of individual to be hanged. Only Pelosi (about 5 ft tall) might have been short enough for this noose. Pence was certainly too tall and so was Schumer. Not sure how tall AOC is.
