SCOTUS doesn't believe in section 3 of the 14th amendment, I guess.
More that an individual state isn't the mechanism of enforcing it.
@CLManussier in spite of substantial historical evidence that legislation was not required for enforcement. And that's a type of evidence that this court purports to *really* care about.

What's to stop Gregg Abbott and DeSantis from pushing a resolution through their captive legislatures naming Biden an "insurrectionist" and kicking him off THEIR ballots (and thus ensuring HIS loss, and throwing the decision to the GOP-controlled House)?
Explain that to me.
