Conceptually, I would be okay with basing apportionment entirely on the voting population of each state, rather than the census. A lot of effort goes into ensuring those counts are correct, and that is the population that has arsed itself to participate in the democracy....
Last night I learned that there's a court case (& accompanying documentary film) aimed at actually enforcing section 2 of the 14th amendment. This is the one that says basically, if a state suppresses voting rights, then it will lose seats in the House. It's such an elegant way of combating voter suppression, and has been utterly dormant for its whole life.
