If he has an agenda to improve the integrity of the court, working against this draft would be a reasonable strategy. He may be the one who did the leak. And, he may have done so in a way that is untraceable, so he is comfortable with the investigation.
@jurban It's possible, but I wouldn't put money on that. If it is an actual justice, then the most likely would seem to Breyer who is already on his way out. Far more likely though, is just a lowly staff member who was shocked by what they were seeing.
