I still have a question about the process. I thought the appeals to SCOTUS goes to the justice assigned to that circuit. For the 11th circuit that is Thomas.
So if DOJ wins their appeal with the court, Trump appeals and Thomas accepts the case, further delay.
If Trump wins at the 11th, DOJ appeals, Thomas declines to hear the case.
Maybe the justice representing a circuit can be bypassed? Arcane rules.
