#politics #law Today I'm talking to this guy who claims to be a recovering conservative. And he asks me "Can't we revoke the 5th Amendment if TFG says something in public so he can't deny it?"
I blink a few times. "No we cannot revoke the 5th Amendment. That sounds like something TFG would say."
Jesus on a Surfboard...
We can't drag anyone into criminal court and force them to testify against themselves in America.
Even TFG. Because OUR CONSTITUTION IS MORE IMPORTANT THAN HE IS.
@J_Windrow right? like, I could scream "FIRE!" in a crowded public theater with witnesses.. heck, even caught on closed circuit camera... and in court, if asked "Did you scream "FIRE!" in a crowded theater" I *absolutely* still have the right to not answer that under the 5th. I cannot be forced to testify against myself.
Other side still has to prove, with evidence (witnesses, CC recording) that I did it. Might be the most obvious thing in the world, but that's how the law works.
