@KGinKS I'm cynically thinking that the extreme positioning is a way to force a compromise that delays the trial until after the election. And if Trump wins it will all go away . . . .
And Clarence Thomas should have disqualified himself, but the pro-Trump wing of the court presumably needs him.
I think the best option for Smith is to ask Judge Chutkan to hold an evidentiary hearing to determine if any of the charges relate to presidential duties as opposed to for his personal benefit only. It would put the evidence in front of the public.
