@ChippySuave years ago I represented a woman on appeal. She and a friend were convicted in the murder of her estranged husband.
The trial judge denied any instruction on battered woman syndrome. The evidence was replete with testimony of him stalking and threatening her and the friend (and others). Police were called when he threatened to shoot her and her aunt. Police told him to take a walk!
She and his family gathered. Someone was going to die; better him than them.
@ChippySuave I have always believed if the police had arrested him and taken his gun away the night he terrorized his wife, child, and aunt, that the family would have had greater trust in LEOs and wouldn’t have taken family defense into their own hands.
@ChippySuave his own brother was involved in that meeting, but refused to testify, citing the Fifth Amendment.
@Myrth It only takes one incident to lose that trust. And sadly, only one incident to lose a life.
