if used against our own everyday citizens, it would have been an "illegal order" by definition and as such illegal for any member of the military to obey.
This was, in fact one of the excuses that DoD and other high ranking military officials gave to members of Congress during the hearings: They were afraid that if they came too soon that the the President/Commander-in-Chief might very well order them to use force illegally."
