So far, it seems to me that no one, including Trump's attorney, has raised the issue of whether or not Trump committed insurrection. The question seems to be if a State has jurisdiction (it's a Congress issue).

It was already settled that it was an insurrection.

This hearing is if the President is an officer. And the state Colorado constitution has the ability to remove a candidate based on its ruling on Sec 3

There was a lot of noise on this that was just BS

@Kinnison My point is that has been running around claiming he didn't commit insurrection, and his MAGA members in Congress have been claiming there was no insurrection. (A "peaceful protest.")

So if it was a "peaceful protest" and not insurrection, why isn't Trump's attorney arguing that?

Because Trump is trying the case in the court of public opinion like he always does.

If they tried to challenge the insurrection ruling it ciuld be devastating for so many other cases
