I am no constitutional scholar, but after a cursory search on the internet on the First Amendment, I found the Bradenburg Test

Brandenburg's language about "imminent lawless action" produced the "Brandenburg Test," which requires that in order to punish the speaker, the speech is:

1) directed to inciting or producing imminent lawless action,
AND
2) likely to incite or produce such action.
Trump did that shit.
